What Happens at a 341 Meeting?

A 341 Meeting, also called a 341 Hearing or a Meeting of Creditors, is typically scheduled to occur about 30 days after you file for bankruptcy (Chapter 7 or 13).

Even though the thought of a “hearing” or “meeting of creditors” can be a little scary, there is nothing to be afraid of. The 341 Meeting is a somewhat informal meeting (although you are under oath) between the debtor (you), your bankruptcy attorney, and your bankruptcy trustee. Your creditors are also invited to attend but creditors rarely ever attend 341 meetings.

A bankruptcy trustee is a person appointed by the bankruptcy court to oversee your bankruptcy case. The trustee is an attorney, not a judge. During the course of a typical bankruptcy case, you will not have to appear before a judge.

What is the purpose of a 341 Meeting?

A 341 meeting gives the trustee the opportunity to personally ask you to verify the details of your bankruptcy. Your bankruptcy attorney will attend this meeting with you. The trustee will ask you a few questions. He or she will also ask you for identification, just to verify that you are indeed, the person filing for bankruptcy. The bankruptcy trustee is not out to get you; it is his/her job to verify the accuracy of your bankruptcy petition.

What questions will the trustee ask?

During the 341 meeting, you will be under oath and you should answer all questions truthfully. The trustee will ask you to verify your legal name and your address. You could be asked if you have recently sold or transferred any property. You might be asked about your place of employment and your income. You could be asked if you owe any child support. All pretty basic, straight-forward questions.
